Any responsible email marketer is aware of the Federal CAN-SPAM Act of 2003. The FTC has announced four minor changes to the act. Here are the changes and how they might have an impact on some email marketers.
1. Sender list owners needs to be in the “from†line.
Essentially this has little impact on legitimate email marketers but it does mean if you are asking someone else to send to their list for you, the list owner needs to be the company in the email “from”area.
2. Logging into accounts to be removed is no longer allowed.
This new rule will have an impact on a number of companies. Companies can no longer require you to log into and account to be removed from a list. They have to offer you an automatic opt out method that does not require the recipient to log in. For me this is a great change. How many times have you found it hard to opt out because the company requires you to log in first? I know this happens a lot, so I’m looking forward to seeing this change being implemented.
3. Valid postal address must appear on the email body.
This isn’t much of change and will have a minor impact but it is necessary to have a valid postal address in case someone wants to contact you and/or file a complaint against you.
4. The person sending the email must be a valid person.
I’m not sure this will have any real impact and it will be incredibly hard to enforce.
